Federal Court rules Trudeau government decision violated Charter of Rights and Freedoms

trucker's convoy 2022

The Trudeau Government decision to invoke the Emergencies Act in response to the trucker convoy that locked Ottawa in 2022 has been ruled as a violation of the Charter of Rights and Freedoms by the Federal Court.

Justice Richard G. Mosley stated that the decision was “unreasonable” and outside the scope of the law in his ruling.

Mosley stated in writing, “I have concluded that the decision to issue the Proclamation does not bear the hallmarks of reasonableness — justification, transparency and intelligibility — and was not justified in relation to the relevant factual and legal constraints that were required to be taken into consideration.”
