Robert refuses the breath demand resulting in charges of Impaired

On October 20, 2023, officers with Patrol Services charged 38-year-old Robert Allard with operation while impaired and refusal to comply with a breath demand.

Around 2:00 p.m., 911 Communicators received a report of a swerving vehicle in the Trunk Road area. Officers were dispatched to the area and conducted a traffic stop of the vehicle in the 100 block of Trunk Road. Upon speaking with the driver, officers developed grounds to believe their ability to operate a motor vehicle was impaired by alcohol. They were arrested.

The accused complied with the officers’ demand for the first breath sample into an approved screening device – which was above the legal limit – but refused to provide the second sample.

The accused is charged with:

  • Operation While Impaired – Drugs and/or Alcohol
  • Refusal or Failure to Comply with Breath Demand

The accused was held in custody pending a bail hearing.
